Should a Pregnant Woman Be penalize for Exposing Her Fetus To Risk?

Determining whether or not a viable fetus is considered a psyche has been a constant struggle for many geezerhood in our society. The conclusion to that affirmation is imperative to many different resultant roles. One main issue that has a lot of dispute concerning this topic is whether or not a pregnant woman should be punished for exposing her fetus to risk. However, once a viable fetus is determined to pose the same value or meaning as person there argon many other concerns that become germane(predicate) to this issue. Drug abuse is the main source of concerns. Most slew focus on criminalizing the mothers who use illegal drugs during pregnancy firearm many legal drugs such as alcohol and cigarettes heap have just as many negative affects to a fetuss health. Punishing a mother who has unfastened her fetus to risk, no matter what the risk was, can be helpful and beneficial to society and give the fetus a better chance at life.
In the Whitner v. South Carolina strip a pregnant mother, Cornelia Whitner, pleaded guilty to criminal boor lack because her baby was born with cocaine metabolites in its system. She was sentenced to eight years in prison and she did not appeal the courts decision.



However, she filed for a petition of PCR which stands for Post Conviction Relief. She filed for this petition collectible to the ineffective assistance of her counsel. She claims that her counsel did not inform her that her disrespect might not pertain to prenatal drug use. She claimed that a fetus was not covered in the code that saved all children. However in 1960, in the case lobby v. Murphy the state of South Carolina recognized that viable fetuses are persons. Meaning that the ruling of this case claimed that a fetus was include in the rendering of a child.
