2. Facts of the Case
Furman was breaking into a private national owned by William Joseph Micke Jr; after the Mickes had gone to bed they started to run into noise in the kitchen. They believed one of their five kids was sleep locomote and went to see what was going on. As William got to the kitchen he found 26 year old Furman a mentally ill char guy in his kitchen with a gun. Furman panicked and tried to happen away and as he tried to run sullen he tripped and fell and shot at William and instantly killed him. The family called the constabulary and they caught Furman, he was convicted of murder and sentenced to the conclusion penalty.
The Supreme Court public opinion was 5 to 4 which meant five of the justices believed Furmans punishment was condemnable and crotchety but none of them could agree on wherefore they had all decided that, so they chose to each write a separate justification of their decision.
The lower courts control against Furman they said that the terminal penalty in this case was not considered cruel and unusual punishment but Furman appealed their decision and the Supreme Court ruled in favor of Furman.

Issue:
Does the imposition and carrying out of the death penaltyconstitute cruel and unusual punishment in violation of the 8th ; excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted and 14th amendment; rights of citizens. (Page 66 Herda).
4. Arguments:
For Furman:
* absolute majority civil western nations had gotten rid of death penalty because they detect it didnt help decrease crime.
* Others had been given the death penalty as well which was about 100 per year and save ½ of those prisoners were actually put to death, so they believed the death penalty wasnt being distributed fairly.
* Records of national prisons showed that most of the executions in the state of Georgia had to do with black people.
